Terms of Service

1. Eligibility

You must be legally capable of forming a binding contract in your jurisdiction (or have parental/guardian consent where required). You agree to comply with all applicable laws when using the Service.

2. Accounts & Security

• One account per person. Creating or maintaining multiple accounts is prohibited and may result in suspension or termination.
• You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
• We may take actions we deem necessary to protect the Service and our community, including suspending or terminating accounts that violate these Terms or our Acceptable Use rules.

3. Virtual Items, Credits & Purchases

• The Service may offer virtual items, currency (e.g., credits), features, or subscriptions (collectively, “Purchases”). Purchases are licensed to you, not sold, and have no real‑world monetary value outside the Service.
• All sales are final to the fullest extent permitted by law. Prices and availability may change without notice. Taxes may apply.
• We may limit, modify, or discontinue virtual items or credits at any time. We are not responsible for lost or deleted virtual items due to violations, inactivity, or technical issues.

4. Subscriptions & Renewals

• If you purchase a subscription, it will auto‑renew at the end of each term unless cancelled in your platform account settings before renewal.
• Platform billing (e.g., Apple App Store, Google Play) terms and policies govern the purchase, renewal, refunds, and cancellation mechanics.

5. User Content & License

• You retain ownership of content you submit or display (“User Content”). You grant us a worldwide, non‑exclusive, royalty‑free license to host, store, reproduce, modify, and display your User Content solely to operate and improve the Service.
• You represent that you have the rights necessary to grant this license and that your User Content complies with these Terms and applicable law.

6. Acceptable Use & Prohibited Conduct

When using the Service, you agree not to:

• Violate any law, infringe others’ rights, or post unlawful, harmful, or hateful content.
• Harass, threaten, or exploit others, including minors; attempt to obtain personal data from minors.
• Cheat, exploit bugs, use automation/bots, or interfere with fair play or the operation of the Service.
• Upload viruses or malicious code, attempt to gain unauthorized access, or disrupt networks or servers.
• Impersonate any person or entity, or misrepresent your affiliation.
• Engage in real‑money trading or selling accounts, items, or credits outside mechanisms expressly permitted by us.

We may remove content, restrict features, or take enforcement actions for violations.

7. Intellectual Property

The Service, including all text, graphics, logos, user interface, and software, is owned by OviPets or its licensors and is protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, or create derivative works of the Service.

8. Third‑Party Services

The Service may link to or depend on third‑party services (e.g., app stores, payment processors). Those services are governed by their own terms and policies, and we are not responsible for their actions.

9. Privacy

Your use of the Service is also subject to our Privacy Policy, which explains how we collect and process personal data.

10. Suspension & Termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, pose a risk to the community, or for operational or legal reasons. Upon termination, all licenses and rights granted to you will cease.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON‑INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR‑FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OVIPETS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM (OR USD $10 IF YOU HAVE NOT PAID).

13. Indemnification

You agree to indemnify and hold harmless OviPets and its affiliates from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from or related to your use of the Service or your violation of these Terms.

14. Platform-Specific Terms

If you access or download OviPets from the Apple App Store, you acknowledge and agree that the use of the application is also governed by Apple’s Standard End User License Agreement (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ . In the event of any conflict between these Terms and the Apple EULA, the Apple EULA will prevail with respect to your use of the iOS or macOS version of the app.

If you access or download OviPets from Google Play, your use of the application is also subject to the Google Play Terms of Service and the Google Play Developer Distribution Agreement , as applicable. In the event of any conflict between these Terms and Google’s terms, Google’s terms will control with respect to your use of the Android version of the app.

15. Governing Law & Disputes

These Terms are governed by the laws of Singapore, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the courts located in Singapore, unless applicable law requires otherwise.

16. Changes to the Service & Terms

We may modify the Service and these Terms from time to time. If changes are material, we will provide notice (e.g., by posting in‑app or on our website) and indicate the “Last updated” date above. Your continued use of the Service after the changes become effective constitutes acceptance of the revised Terms.
